Shipping and Returns

Price and shipping charges

The prices of the Products published on the homepage or in the different sections of the Site are inclusive of VAT and do not include any taxes, duties and duties applicable in the country of destination of the Products, where this is different from Italy, which will be borne by the Customer. Shipping costs will vary depending on the order as specified in the blue area at the beginning of the Site.

Deliveries and Invoicing

Invoices will be issued exclusively in electronic format and sent by e-mail.

Deliveries will be made by carriers according to the order placed. The cost of shipping will be 8 euros in the Italian territory and 50 euros outside the Italian territory, in case the minimum estimated amount is not reached. In case of discount periods, FIVE will reserve the right to apply the shipping cost according to the carrier. Where the FIVE Product is marked on the Site as "available", FIVE will deliver the said item(s) to the carrier within a maximum period of seven (7) business days following confirmation of payment, subject to the shorter period that will be communicated by e-mail to the Customer.

FIVE shall not be liable for non-delivery or delayed delivery in the event that: (a) despite having made regular and timely purchase of the Product(s) to cover the Order received, it has not been supplied within the terms and manner agreed with the supplier; (b) it is unable to make up for the unavailability of such Product(s), due to circumstances beyond its control; and (c) it has promptly notified the Customer of such unavailability of the FIVE Product(s). In any event, where the Customer is a Consumer and the unavailability of FIVE Products, due to any of the circumstances set forth in (a) and (b) above, does not permit delivery of the FIVE Product within 30 (thirty) days of the placing of the Order by the Consumer, FIVE will refund to the Consumer any advance payments. FIVE shall not be liable for non-delivery or delayed delivery due to force majeure causes, such as - but not limited to - strikes, Public Authority measures, rationing or shortages of energy or raw materials, transportation difficulties, fires, floods, and damage to industrial machinery not within FIVE's control. FIVE will promptly notify the Customer of the occurrence and disappearance of a force majeure cause. Should the force majeure cause persist for a period exceeding 30 (thirty) days, either party shall be entitled to withdraw from the contract. In the event of withdrawal pursuant to this point 5.5, the Customer shall not be entitled to any compensation or indemnity for any reason whatsoever, without prejudice to the right to a refund of any amount already paid by way of price for the FIVE Product that is the subject of the Order, within 30 days from the sending of the Order.

In the event of a purchase made by a Consumer, the risk of accidental loss of the FIVE Products shall remain with FIVE until their delivery to the Consumer or to another person indicated by the Consumer. In the case of a purchase made by a person other than a Consumer, the risk of

accidental loss of the item shall pass to the Customer with the delivery of the Product by FIVE to the first carrier.

Delivery of the purchased Products

Deliveries of the purchased Products are made on the Italian territory and in the permitted countries.

The Customer acknowledges that the pick-up of the Product is his precise obligation arising from the purchase contract. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the courier will leave a card to certify the delivery attempt (so-called notice of passage).

After two unsuccessful delivery attempts, the package will be returned to Five.

The Customer acknowledges that since the package is returned to FIVE, the contract may be considered terminated and the purchase order cancelled pursuant to Article 1456 of the Civil Code. Resolved the contract, FIVE will proceed to refund the amount, if already paid by the Customer, minus the costs of the unsuccessful delivery of the Product, as well as the costs of returning it to Five and any other expenses that Five has incurred due to the non-delivery caused by the recipient. The termination of the contract and the refund amount will be communicated to the Customer via e-mail. The refund amount will be credited, where possible, to the means or payment solution used by the Customer for thepurchase.
