This page describes how the site is managed with regard to the processing of personal data of users who consult it.

The information is provided only for this site and not also for other websites that may be consulted by the user through links.

The information is also based on Recommendation No. 2/2001 that the European authorities for the protection of personal data, meeting in the Group established by Article 29 of Directive No. 95/46/EC, adopted on May 17, 2001 to identify certain minimum requirements for the collection of personal data online, and, in particular, the manner, timing and nature of the information that the DATA CONTROLLER must provide to users when they connect to web pages, regardless of the purpose of the connection.

THE "OWNER" OF THE PROCESSING

Following consultation of this site, data relating to identified or identifiable persons may be processed.

WHAT DATA WE COLLECT

As a result of your navigation of the Site, or your registration to the personal area of the Site or to the newsletters are collected, always if voluntarily entered by you in the spaces provided, the identification data of your person or to one or more characteristic elements of your physical, physiological, psychic, economic, cultural or social identity suitable to make you identified or identifiable (hereinafter only "Personal Data"), which may consist - by way of example and also depending on your decisions on how to use the Services - of your first name, last name, the city and postal code address of your residence, e-mail address, tax code, chosen or adopted payment method and means, identification number (customer code), online identifier.

Your Personal Data may be collected either because you voluntarily provide it (e.g., when you subscribe to the Newsletter or when you create your personal account in order to receive the Services offered by the HOLDER) by analyzing your behavior on the Site or simply because it is automatically acquired by the systems for functional needs.

The Personal Data processed through the Site are as follows:

a. Name, contact details and other Personal Data.

In various sections of the Site, particularly the section on creating a personal account, you may be asked to enter information such as your name, phone number, e-mail address, date of birth, country of residence, address, social security number etc.

While using the Services, you may also be asked to enter information about your payment method, such as Paypal or credit card.

This information is provided by you voluntarily and under your personal responsibility. Please keep in mind that most of this data is used to provide a specific service (e.g., online purchases, shipments, payments, refunds) or to comply with legal obligations, including those of a fiscal or tax nature, and that therefore the processing of these data and their communication to third parties for the aforementioned purposes is lawful merely because you have provided them and that in the absence of consent, the related service cannot be provided.

Please also keep in mind that in case you have processed, provided or registered on the Site the personal data of third parties, you guarantee, assuming all responsibility, that such activity of yours is based on the consent of the third party concerned.

b. Location data

Subject to your prior and explicit consent, your Internet browsing program (so-called "Browser") or your device may share with the Site your geographic location more or less approximated depending on the geolocation services used (GPS, wi-fi access points or IP address assigned by your ISP to your device).

If you feel that access to your geographic location, even approximate, through sharing via Browser or device is too intrusive, you can always revoke your consent from your Browser settings (or your operating system settings). Keep in mind that your IP address is public, not obscurable, and is always disclosed to the sites you visit.

c) Browsing Data

For the operation of this website, the computer systems and software used acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform Resource Identifier) notation addresses of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment.

These data are used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct operation and are deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site: except for this eventuality, at present the data on web contacts do not persist for more than seven days.

d) Cookies

No personal data of users is acquired by the site in this regard.

No use is made of cookies for the transmission of information of a personal nature, nor are persistent cookies of any kind, or systems for tracking users, used.

The use of session cookies (which are not stored persistently on the user's computer and disappear when the browser is closed) is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to enable the safe and efficient exploration of the site.

The session cookies used on this site avoid the use of other computer techniques potentially prejudicial to the confidentiality of users' browsing and do not allow the acquisition of personal data identifying the user.

FOR WHAT PURPOSES WE PROCESS YOUR DATA

The HOLDER will use your Personal Data, collected through the Site, for the following purposes:

-to provide Services such as: to verify your identity and help you, in case you lose or forget the login/password details of your personal account on the Site; to allow you to view your purchase history; to send you Imperfect's newsletter that you have requested as a Service by signing up and that contains only informational and non-commercial material; to finalize your purchase order and deliver to you the products that you can purchase on the Site; to allow you to save your favorite items; and to provide you with any other Services you request ("Service Provision");

-to create a profile of you through the use of profiling cookies, where accepted, therefore collecting and analyzing information about the selections and choices you make on the Site; as well as your general activities on the Site when you are a registered user, therefore collecting information about your proceeding purchases, whishlists and browsing. This profile will be used to provide you with information about other products and/or services that HOLDER believes may be of interest to you and to show you advertisements that may be relevant to your tastes. All algorithms involved in this automated or semi-automated process are regularly tested to ensure that you are not offered products that you are not interested in ("Profiling");

MANDATORY OR OPTIONAL NATURE OF PROCESSING

The legal bases used by the DATA CONTROLLER to process your Data, according to the purposes indicated in the preceding Paragraph, are as follows:

-Providing the Service: processing for this purpose is necessary in order to provide you with the Services and, therefore, for the performance of the contract. It is not mandatory to provide the HOLDER with your Personal Data for this purpose, but

otherwise it will not be possible to provide you with any Services. The same applies to the Newsletter Service which arises from your specific request through the entry of an e-mail address and which you can revoke at any time by sending an e-mail to the following e-mail address:

-Marketing: processing for this purpose is based on your consent. You are not required to give your consent to the DATA CONTROLLER for this purpose and you are free to revoke it at any time without any consequences (except that you will no longer receive marketing communications from the DATA CONTROLLER). You may revoke your previously given consent by following the directions in Section 8 of this Notice.

-Profiling: processing for this purpose is based on your consent. It is not mandatory to give your consent to the HOLDERs for this purpose and you are free to revoke it at any time without any consequences (except the inability to benefit from the personalization of commercial offers you receive from the HOLDERs). You may revoke your previously given consent by following the directions in Section 8 of this Notice.

-Compliance: processing for this purpose is necessary for the HOLDERs in order to comply with any legal obligations. When you provide Personal Data to the HOLDERs, it will need to be processed in accordance with applicable law, which may involve its retention and disclosure to the Authorities for accounting, tax or other obligations.

-Abuse/Fraud: The information collected for this purpose will be used solely to prevent and/or detect any fraudulent activity or abuse in the use of the Site and therefore allows the HOLDERs to protect themselves in court.

SHARING OF YOUR DATA

Your Personal Data may be shared with the following present parties (the "Recipients"):

-subjects that typically act as data processors i.e.: i) persons, companies or professional firms that provide accounting, administrative, legal, tax, financial and debt collection assistance and advice to the DATA CONTROLLERS with respect to the provision of the Services;

-subjects with whom it is necessary to interact for the provision of the Services (for example, hosting providers or providers of platforms for sending emails);

-subjects delegated to perform technical maintenance activities (including maintenance of network equipment and electronic communication networks);

-persons authorized by the DATA CONTROLLER to process Personal Data necessary to perform activities closely related to the provision of the Services, who have committed to confidentiality or have an appropriate legal obligation of confidentiality (e.g., employees of the DATA CONTROLLER);

-subjects, entities or authorities to whom it is mandatory to disclose your Personal Data for Compliance, Abuse or Fraud purposes, or by order of the authorities;

TRANSFERS OF PERSONAL DATA

Outside of the cases mentioned in the previous paragraph, your Personal Data will not be transferred to other parties.

PROCESSING METHODS

Personal data are processed by automated tools for the time strictly necessary to achieve the purposes for which they were collected.

Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access.

STORAGE OF PERSONAL DATA

Personal Data processed for the purpose of Provision of Services will be retained by the DATA CONTROLLER for as long as is strictly necessary for the said purpose (e.g. for sending the purchased product). However, as such Personal Data is processed to provide you with the Services, the HOLDER may retain it for a longer period, particularly as may be necessary to protect the HOLDER's interests from possible claims related to the Services.

Personal Data processed for Marketing and Profiling purposes will be retained by the HOLDER until you revoke your consent. In any case, we will remind you of the consents you have given us every 24 months. Once you revoke your consent, the HOLDER will no longer use your Personal Data for such purposes, but may still retain it, particularly as may be necessary to protect the HOLDER's interests from possible claims based on such processing.

Personal Data processed for the purpose of Compliance will be retained by the DATA CONTROLLER for the period required by specific legal obligations or applicable law.

The Personal Data processed for the purpose of preventing Abuse/Fraud will be retained by the DATA CONTROLLER for as long as strictly necessary for the above purpose and thus until such time as the DATA CONTROLLER is required to retain it to protect itself in court to disclose such data to the relevant Authorities.

RIGHTS OF THE DATA SUBJECTS

You have the right to request from the DATA CONTROLLERS, at any time:

-access to your Personal Data, (or a copy of such Personal Data), as well as further information about the ongoing processing of such Personal Data;

-correction or updating of your Personal Data processed by the HOLDER, where it is incomplete or out of date;

-the deletion of your Personal Data from the databases of the HOLDERs;

-the restriction of the processing of your Personal Data by the HOLDERs;

-to obtain in a structured, commonly used and machine-readable format Personal Data about you;

as well as you may:

-consent to the processing of your Personal Data by the HOLDER.

-revoke your consent for Marketing and Profiling purposes.

Please note that most of the Personal Data you have provided to the HOLDER can be accessed and/or modified at any time by accessing, where possible, your personal account created on the Site. Please note that at any time you may request that your account be deleted in its entirety.

When requesting the Services, you may have selected which communication channels through which you wish to be contacted for Marketing purposes.

You may revoke consent for Marketing related to each of these communication channels through your personal account on the Site by unchecking the relevant options. You may also revoke consent for Marketing sent by e-mail by using the appropriate link at the bottom of each e-mail you receive. The same manner may be used to stop receiving IMPERFECT's newsletter, where you have requested it as a Service.

In any case, you always have the right to lodge a complaint with the competent Supervisory Authority (Garante per la Protezione dei Dati Personali) if you believe that the processing of your Personal Data is contrary to the regulations in force.

The subjects to whom the Personal Data refer have the right at any time to obtain confirmation of the existence or non-existence of the same data and to know its content and origin, verify its accuracy or request its integration or updating, or rectification.

Pursuant to the same article, one has the right to request the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, as well as to oppose in any case, for legitimate reasons, their processing.
